2. Collection and saving of personal data and type and purpose of their use

While visiting our website www.schwippert.de, resp. www.schwippert.eu the browser of your device automatically sends information to the server of our website. This information will be saved temporarily in a logfile. The following information will be collected automatically and saved until automatically being deleted:

– IP-address of the requesting device,
– Date and time of access,
– Name and URL of the requested data,

Website, from which access was made (Referrer-URL),

Browser used and the system of the user and the name of your access-provider.

The collected data will be processed by us for the following purposes:
– to maintain a smooth connection of the website,
– to maintain a comfortable usage of our website,
– analysis of system security and stability, as well as
– administrative purposes.

The legal basis for the processing of data is Art. 6 para 1 lit. f GDPR. Our legitimate interest results from above mentioned purposes. In no event we will use collected data to make any conclusion of your person.

Should you contact us (e.g. by email, we shall process your data in order to respond to your request as well as for the purpose that any follow up questions occur.

The data submitted by email will be used for the purpose of administering of and responding to your enquiry only. Any additional personal data will be processed only, if you consent thereto (Art. 6 para. 1 lit a) GDPR) or we have a legitimate interest in processing your data (Art. 6 para. 1 lit f) GDPR). A legitimate interest is the abovementioned purpose, i.e. to respond to your email.

4. Disclosure of Data

A transfer of your personal data to third parties for other that the cases mentioned below will not happen.

Your personal data will be transmitted to third parties only, if:
you have given your consent as per Art. 6 para. 1 lit. a) GDPR,
the transmission is necessary to raise, execute or defend rights as per Art. 6 para 1 lit.f) GDPR and there is no indication to assume that this interest is overriden by your fundamental right and freedoms to protect your personal data,
there is a legal obligation for the processing as per Art. 6 para 1 lit. c) GDPR as well as legally permissible and necessary for the performance of a contractual relationship with yourselves as per Art. 6 para 1, lit. b) GDPR.

5. Rights of the Affected

You have the right:
to ask for access to information about the personal data processed by us as per Art. 15 GDPR;
to rectification, i.e. to demand the correction of incorrect or completion of incomplete personal data save by us without delay. As per Art. 16 GDPR;
to demand the erasure of your personal data saved by us as per Art. 17 GDPR, unless the processing is pursued in execution of a right to free expression of opinion and information, for the performance of a legal obligation, for reasons of public interest or to establish, exercise or defend legal claims;
to request the restriction of processing of personal data as per Art. 18 GDPR, as far as the accuracy of the data is contested by you, the processing would be unlawful, you reject the erasure, although we do not need them anymore, but you would require them to establish, exercise or defend legal claims or you have raised an objection against the processing as per Art 21 GDPR;
to receive the personal data, which you have provided us with, in a structured, commonly used and machine-readable format as per Art. 20 GDPR and to request the transmission to another data controller;
to withdraw the previously given consent as per Art. 7 para. 3 GDPR. This has the effect that we shall not be permitted to continue the processing of data given to us previously in the future, and
to lodge a complaint with the supervising authority as per Art. 77 GDPR. In general, you may address this at the supervisory authority in the EU member state of your habitual residence or place of work or the place of the alleged infringement.

6. Right to object

As far as your personal data had been processed pursuant to legitimate interest as per Art. 6 para. 1 lit. f) GDPR, you have the right to object as per Art. 21 GDPR to the processing of your personal data, as far as there are reason, which results from a specific situation or the objection relates to direct marketing. In the latter case you have a general object right, which without mentioning specific reasons will be implemented by us.
